Welcome to CrownVote. By accessing or using our platform, you agree to be bound by these Terms and Conditions. Please read them carefully before participating in any voting activity.

1. Overview

CrownVote provides a digital platform for organizing and participating in voting activities, including awards voting and official elections. Our goal is to facilitate secure, transparent, and fair voting experiences for all participants.

2. Participation Rules

2.1 Awards Voting

Awards voting on CrownVote is transaction-based. This means:

  • Participants may cast multiple votes for a contestant, subject to the payment structure defined for the event.
  • Each successful payment corresponds to a defined number of votes.
  • Participants acknowledge that outcomes may be influenced by the total number of votes cast.

2.2 Official Elections

Official elections on CrownVote are identity-based. This means:

  • Each eligible voter may vote only once per category, unless otherwise specified by the event organizer.
  • Duplicate or fraudulent voting attempts may result in disqualification of the affected votes.

3. Eligibility and User Conduct

To use CrownVote, you must:

  • Be at least 18 years of age, or have the consent of a parent or legal guardian if you are between the ages of 13 and 17. CrownVote does not knowingly permit users under 13 to participate in paid voting activities.
  • Provide accurate and truthful information when registering or participating.
  • Refrain from attempting to manipulate, disrupt, or interfere with any voting process on the platform.

CrownVote reserves the right to suspend or restrict access for users found in violation of these Terms.

4. Organizer and Creator Responsibility

4.1 Event Creator Liability

Any individual or entity that creates an election or event on CrownVote ("Organizer" or "Creator") accepts direct responsibility for the conduct of participants who use services created on their behalf. Specifically:

  • Organizers are responsible for ensuring their events comply with applicable laws and regulations in Ghana and any other jurisdiction where their event is promoted or accessible.
  • Organizers are liable for any harm, loss, or legal violation arising from misleading, fraudulent, or unlawful event descriptions or structures they create on the platform.
  • Organizers must not use CrownVote to facilitate illegal activities, including fraudulent fundraising, vote manipulation, or misrepresentation of event outcomes.
  • CrownVote acts solely as a technology provider and is not responsible for the conduct, promises, or representations made by Organizers to their participants.

4.2 Participant Conduct Under Organizer Events

Participants who engage with Organizer-created events do so under the combined governance of these Terms and any additional rules set by the Organizer. Where an Organizer's rules conflict with these Terms, CrownVote's Terms take precedence.

5. Voting Integrity

  • CrownVote implements reasonable safeguards to ensure votes are properly recorded and counted.
  • Voting results are generated based on data captured within the system at the time of tallying.
  • Event organizers may define additional rules for their events, which participants agree to follow upon participation.

7. Privacy and Data Protection

CrownVote is committed to protecting your personal information in accordance with the Ghana Data Protection Act, 2012 (Act 843) and applicable data protection principles.

  • We collect only the data necessary to provide and improve our services.
  • Payment information is processed by certified third-party payment processors and is not stored directly by CrownVote.
  • Identity data collected for official elections is used solely for voter verification purposes.
  • We do not sell or share your personal data with third parties for marketing purposes without your consent.

8. Security and System Reliability

CrownVote implements appropriate technical and organizational measures to protect the security and reliability of our platform. We continuously work to safeguard your data and voting records.

However, no digital system can guarantee absolute security or uninterrupted operation at all times. CrownVote does not warrant that the platform will be entirely error-free under all circumstances. In the event of a security incident affecting your data, we will notify you as required by applicable law.

9. Results and Disputes

Results are determined based on data recorded within the CrownVote system at the time of tallying. If you believe a result is inaccurate, you may contact our support team.

CrownVote will review reported issues in good faith; however, we do not guarantee the reversal of results. For Organizer-managed events, the Organizer may retain final authority over event outcomes as defined in their event rules.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any matters not expressly covered by these Terms shall be subject to applicable Ghanaian law, including but not limited to the Electronic Transactions Act, 2008 (Act 772) and the Data Protection Act, 2012 (Act 843).

10.2 Dispute Resolution

In the event of a dispute arising out of or in connection with these Terms, the parties agree to first attempt resolution through good-faith negotiation. If a dispute cannot be resolved informally within 30 days, it shall be submitted to mediation or arbitration in Accra, Ghana, under the rules of the Ghana Arbitration Centre, before either party initiates formal legal proceedings.

10.3 Jurisdiction

By using CrownVote, you consent to the exclusive jurisdiction of the courts of Ghana for any disputes that proceed beyond arbitration.

11. Force Majeure

CrownVote shall not be held liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from circumstances beyond CrownVote's reasonable control. This includes but is not limited to acts of God, power outages, cyberattacks, government actions, internet infrastructure failures, or any other event that could not have been reasonably foreseen or prevented.

In such circumstances, CrownVote will make reasonable efforts to resume normal service as promptly as possible and will communicate relevant updates to affected users and organizers.

12. Limitation of Liability

To the fullest extent permitted by Ghanaian law, CrownVote's liability to you for any claim arising from the use of our platform shall be limited to the amount you paid for the specific transaction giving rise to the claim.

CrownVote shall not be liable for any indirect, incidental, or consequential damages arising from use of the platform, including loss of data, financial loss, or perceived inaccuracies, where such damages were not directly and reasonably foreseeable.

This limitation does not apply to liability arising from fraud, gross negligence, or intentional misconduct by CrownVote.

13. Modifications to These Terms

CrownVote reserves the right to update or modify these Terms at any time. Where changes are material, we will provide at least 14 days' notice via email or a prominent notice on our platform before the changes take effect. Continued use of the platform after that notice period constitutes your acceptance of the updated Terms.
